Appellate Law
Appellate work is an important part of McManis Faulkner’s practice. From commercial disputes to family law matters and criminal convictions, we handle appeals in cases where we have represented the client at trial and in cases where we are newly engaged in the underlying matter. Our attorneys have both state and federal appellate experience. 

Appellate law requires research and writing skills as well as the ability to frame a persuasive legal argument. Our attorneys are strong in these areas and they are also excellent oral advocates.

A special area of expertise concerns anti-SLAPP suit cases.  The anti-SLAPP suit statute—California Code of Civil Procedure Section 425.16—was enacted to protect the constitutional rights of free speech and petition. SLAPP is an acronym for “Strategic Lawsuits Against Public Participation.”  A SLAPP suit is typically intended to stifle public debate because of the expense of defending the action and the fear of a judgment if one loses. California enacted anti-SLAPP suit legislation in 1992. The statute has been amended and expanded several times. Anti-SLAPP suit motions are now one of the strongest procedural protections the law affords. If successful, the party bringing the motion may have the case dismissed and be awarded attorney fees.
